What Does A Request For Supersedeas Mean In Pennsylvania Work Comp Case?

A request for Supersedeas is the request by the employer/insurer to reduce the indemnity (wage loss) portion of the claim based on evidence presented at the first hearing on a Termination, Modification, or Suspension Petition.

Medical benefits continue as litigation proceeds in these types of petitions. So, it’s the wage loss that is being challenged. The injured worker and his/her lawyer can defend the request for Supersedeas and submit evidence (documents) to dispute it. The Judges tend to deny Supersedeas as long as the injured worker’s lawyer submits appropriate documentation. This means that the wage loss benefit will continue as the case proceeds- less the attorney’s fee if the worker is represented by counsel.
