Workers’ Comp Lawyer Michael Cardamone Interviewed Regarding House Bill 1840

Michael W. Cardamone, owner of Cardamone Law, LLC, a well known PA Work Comp Law Firm for Injured Workers, was interviewed this week by Business Insurance Dot Com regarding Pennsylvania House Bill 1840.  The Bill seeks to reinstitute Impairment Rating Evaluations under the Pennsylvania Work Comp Act, after the Pennsylvania Supreme Court struck down the IRE provisions of the Act in the Protz Decision.  Bill 1840 uses the 6th Edition of the AMA Guides to Permanent Impairment.

As Claimant’s lawyers, we feel the Bill is flawed, and if passed, will be quickly challenged by a Claimant’s firm like ours.  The Protz Decision made clear that it’s unconstutitional to delegate authority to a private entity like the AMA.  Our hope is that the Senate votes it down.
