It is important to note that every case is unique. There are many factors to take into account in determining the fair value of a workers’ compensation settlement. All settlements have to be approved by a Work Comp Judge- to ensure that the injured worker understands the full legal significance of their decision to settle with the Employer/Insurer. There is no pain and suffering in workers’ compensation in Pennsylvania. It is a no fault system. The available benefits are for lost earning power and medical expenses.
